This website is operated by Altitude Fans.  Throughout the site, these terms refer to Altitude Fans as the seller and to you, the user, as "you." By visiting altitudefans.com or purchasing from us, you agree to these Terms of Service, including any additional terms and policies referenced here or linked from this page — among them our Refund & Return Policy and Privacy Policy, which form part of these Terms.

If you do not agree to these Terms, please do not use this site or purchase our products. New features, products, and tools added to the store are also subject to these Terms. We may update these Terms at any time; the version posted here is the version in effect.

2. Eligibility and Store Use

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence and that you have the legal capacity to enter into this agreement. You may not use our products for any illegal or unauthorized purpose, or violate any law in your jurisdiction (including copyright laws) in using the service. A breach of these Terms will result in immediate termination of your access.

3. Products, Finishes, and Availability

Products sold on this site are intended for residential and light commercial use. We make every effort to display our products, finishes, and colors accurately, but we cannot guarantee that your display will show them accurately — actual finish, color, and wood grain may vary from what appears on screen, and natural materials vary from piece to piece. We recommend ordering a sample or contacting us before purchasing multiple units where an exact finish match matters.

Product availability is not guaranteed. We may limit the quantities of any product, discontinue any product, or limit sales to any person, geographic region, or jurisdiction at our discretion. Specifications, dimensions, and features may change without notice as products are improved.

4. Ordering, Pricing, and Payment

Your order is an offer to buy. We accept your offer when we ship the item; until then we may decline or cancel any order for any reason, including suspected fraud, ordering errors, or product unavailability. We will notify you and refund any amount charged if we cancel.

All prices are in US dollars and are subject to change without notice. Occasionally information on our site may contain typographical errors or inaccuracies relating to price, description, promotions, or availability. We reserve the right to correct such errors and to cancel any order placed based on incorrect information, even after the order has been submitted and your payment method charged.

You agree to provide current, complete, and accurate purchase and account information for all purchases. Applicable sales tax is calculated at checkout based on your shipping address and prevailing law.

5. Shipping and Delivery

We currently ship within the continental United States only. Delivery estimates are estimates, not guarantees; we are not responsible for carrier delays or for delays caused by weather, carrier capacity, or events outside our control.

Title and risk of loss pass to you upon delivery to the carrier. Please inspect all shipments on arrival and note any visible damage on the carrier's delivery receipt before signing. Damage, shortage, and wrong-item claims are handled under our Refund & Return Policy.

6. Installation and Safety

Please read this section carefully. Ceiling fans are electrical products that mount overhead.

• Installation must be performed in accordance with the instructions supplied with the product, the National Electrical Code, and all applicable state and local codes. We strongly recommend installation by a licensed electrician.
• Fans must be mounted only to an outlet box or support listed for ceiling-fan support and rated for the weight and motion of the fan.
• Products must be installed only in the environment for which they are rated. A fan rated for dry locations must not be installed in a damp or wet location such as a covered porch, patio, bathroom, or exposed outdoor area.
• Follow all minimum blade-height and clearance requirements stated in the product instructions.

You are responsible for verifying that a product is suitable for your intended application before installation. Installing a product improperly, in an unrated environment, or contrary to code voids the limited warranty and may create a risk of fire, electric shock, or injury.

7. Limited Warranty and Disclaimer

Altitude Fans warrants the fan motor against defects in materials and workmanship for the lifetime of the original purchaser, and all other components for two years from the date of purchase, excluding glass or acrylic blades, under normal residential use. Proof of purchase is required. Our sole obligation under that warranty is the repair or replacement of the defective product or part, at our option. The customer is responsible for shipping the product for warranty evaluation and for removal and reinstallation costs. The warranty does not cover labor, installation or removal costs, freight, consequential damages, or damage resulting from improper installation, misuse, alteration, accident, abuse, or installation outside the product's rated environment. Except for that express limited warranty, and to the fullest extent permitted by law, products and services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you; where implied warranties cannot be excluded, they are limited in duration to the term of the express limited warranty above.

We do not warrant that the site will be uninterrupted, timely, secure, or error-free, or that any content is accurate or reliable.

8. Limitation of Liability

To the fullest extent permitted by law, Altitude Fans, its parent, affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, or damages arising from installation, use, or inability to use any product, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to any product or these Terms will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; in those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability for personal injury caused by our negligence or for fraud, where such limitation is not permitted.

9. Indemnification

You agree to indemnify, defend, and hold harmless Altitude Fans and its parent, affiliates, officers, directors, employees, contractors, and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your improper installation or use of any product.

10. Accuracy and Completeness of Information

Content on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. Historical information is provided for reference and may not be current. We have no obligation to update any information on the site, though we may modify content at any time.

11. Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to infringe our or any third party's intellectual property rights; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish, scrape, or crawl; or to interfere with the security features of the site.

Obligations and liabilities incurred before termination survive it.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions will remain in full force. Our failure to exercise or enforce any right is not a waiver of it. These Terms, together with the policies posted on this site, constitute the entire agreement between you and us and supersede any prior agreements, whether oral or written.

17. Governing Law and Venue

These Terms and any separate agreements by which we provide products to you are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
